Unrepresented Litigants and Legal Information
There's no denying it: in Quebec, few people can afford the help of a lawyer to assert their rights.
As a result, our judicial system is facing the growing trend of people appearing in court without a lawyer. The numbers are shocking!
Members of the legal community are struggling to cope with the situation, which often places them in an awkward position. The situation is just as difficult for litigants, who feel overwhelmed by the complexity of the system. What can be done?
Is arming litigants with information part of the solution? Do they have a right to information and, if so, is it being met? How far can or should we go in terms of the information we provide?
